Your privacy matters to us (because we value our own privacy as well!). We have made this privacy notice that describes our contact information, and lays out the personal data that we collect in order to process your orders. Additionally, we are making clear all of the services we use in the processing of your orders and in communication together (via email, real-time, or for support tickets). Protecting your personal data
Your personal data is only processed by us with your consent. We adopt data collection, storage, and processing practices to protect against unauthorized access, alteration, disclosure, or destruction. The processing of this information, the purposes for this processing, and the legal ground by which the processing occurs is all described below.
Visiting our site
Embertone uses Google Analytics in order to improve our service and track sales. The collected information is used to give us a bigger picture of how people are interacting with our website. This data may include your IP address, geographical location, browser type + version, OS, referral source, length of visit, page views and website navigation paths, and also information about the timing and frequency of your visit. The source of the usage data is Google Analytics.
Cookies are small text files a Website uses to identify repeat visitors, making their experience much easier and more immediate. Cookies also allow a site to identify usage behavior and compile information that allows for improvement of our content. This information is anonymous and it's only used on an internal basis. And we do NOT share this information externally!
Personal data that we use
Your personal data is only processed by us with your consent. The processing of this information, the purposes for this processing, and the legal ground by which the processing occurs is all described below.
We collect and process your personal details when you register as a user and with the purpose of linking the data to our Software End-User License Agreement ("EULA"). The data is stored until you deregister as a user and stop using our EULA. We rely on your consent of our EULA to which you are an active party as legal grounds for our processing of your details.
Your personal details are shared with the following Third Party Services in order to complete the processing of your order:

Amazon AWS to host our files
MailChimp for Email Marketing
Continuata to allow you an easy download experience via Amazon AWS
PayPal for payment processing
North American Bancard for additional payment processing
Cartloom as our cart system and order tracker
We process the following data:

• Name - typically included in the purchase information, it is necessary to validate your purchase.
• Email - all purchases are required to have a valid email address. Email is also how we communicate with you, to send you downloads, updates, invoices, receipts, and the main way we communicate for technical support requests.
• Phone Number (optional)
• Address - This is necessary should you require an item be shipped to you.
• Professional Details (optional)
• Your website (optional)
• Your VAT number (optional)
• Purchase History - We keep a record of the products you have purchased to better help serve you and for you to have access to downloads.

We also process non-identifiable data via Cookies and Google Analytics (see above).

Please note that your payment details are NOT processed or collected by us. That information is processed through PayPal and North American Bancard.
Disclosure of your information
We don’t share any private or personal information to the public or any third parties without your prior consent, except for when we need to meet legal requirements like accounting, or if there is a legal reason for the courts or in the case of the following:

• Customer/Technical support, where our reps may look up information to help you.
• Accountants who abide by accountant–client privilege and and federal Tax Authorities
• Web developers — to maintain our website and improve your browsing experience.
Your right to be forgotten
You have the right to request that we delete any personal data that we process about you. We will delete the data within one month’s time. We will also, without your explicit demand, delete the data that we have collected but do not longer have a lawful right to process. We will inform you about this, if it would occur. Please be aware that without your information, we will no longer be able to provide you with downloads, invoices, or information about updates and upgrades to our software.
Your right to withdraw consent
If you want to remove yourself entirely from our system, we will do so to the point of maintaining our obligations to the US tax code. For example, we will not delete the sales details necessary for us to comply with the U.S. Internal Revenue Service. However, all other data can be removed, and in doing so you agree to no longer be able to download any Embertone software until you resume a valid user account. In any case, the End User License Agreement (EULA) shall remain in full force throughout perpetuity unless Embertone decides to terminate it. Meaning, you will still have to abide by all of Embertone's EULA terms. Otherwise, we will hold on to this data indefinitely to keep your account active.
Your right of access
You have the right to know what data of yours that we are processing and collecting. At any time you may request a copy of your data referenced above and we will supply you with that information within 30 days of a written request. You, however, must provide enough proof of your identity for us to comply in good faith.

You also have the right to access that personal data and to receive the following information:

 The purposes of the processing
 The categories of personal data concerned
 The recipients or categories of recipients to whom personal data have been or will be disclosed
 The envisaged period for which the personal data will be stored or the criteria used to determine that period
Your right of rectification
You have, at any time, the right to have us to correct any inaccurate personal data. You also have the right to correct any incomplete personal data, taking into account our purposes of the processing, by the means of providing a supplementary statement.
Your right of restriction
You have the right to have us restrict our processing of your personal data. This may be achieved if

 You have reason to believe that the accuracy of the personal data is not correct, and the restriction shall be in place during a period that allows us to verify the accuracy of the personal data
 The processing is unlawful but you don’t want us to delete the personal data
 We no longer need the personal data for the purposes of the processing, but they are required by you for the establishment, exercise or defense of legal claims
Data access
You have the right to receive your personal data., obtainable in a structured, commonly used and machine-readable format. You also have the right to transmit such personal data to another data controller if the personal data is collected based on your consent or if the processing of the personal data is carried out by automated means. If we deem it technically feasible, you have the right to us transmitting the personal data to another controller.
Your right to lodge a complaint
You have, at any time, the right to lodge a complaint with a supervisory authority regarding our processing of your personal data. Regardless of where we carry out our business, even if it would not be in the member state which is your country of residence, you have the right to lodge your complaint to your national supervisory authority.
Our third party services
The online services listed above are themselves responsible for observing the statutory provisions on data protection. In general, these online services also have their own privacy policy, which we have linked above as well, which is binding in this regard. We hereby make it clear that we do not take any responsibility or liability for this.
Amendments
We reserve the right to amend this privacy policy at any time.
